TERMS OF SALE
THE MAKING OF A BID AT THIS AUCTION CONSTITUTES ACCEPTANCE OF ALL OF THE
TERMS OF SALE SET FORTH BELOW:
Agreement: All bidders and others attending this auction agree that they have read and fully understand these terms and agree to be bound by them. The term “Auctioneer” refers to I-5auctions.com and includes the owners, agents and employees of Auctioneer. All public announcements made by Auctioneer at the auction take precedence over any prior printed matter about the auction and such announcements shall be part of these Terms of Sale.
Condition of Items Sold: All items are sold as-is, where-is, with no warranties either express or implied. Neither auctioneer, seller, nor any representative is authorized to make any other representation or warranty about the property. Auctioneer shall not be responsible for incorrect descriptions, genuineness, or defects. Catalogs and advertisements have been prepared only as guides and the accuracy of each is not guaranteed or warranted by Auctioneer. Purchaser acknowledges that it is purchaser’s responsibility to inspect all items prior to bidding. Failure to inspect items will not constitute a ground for any claim, adjustment or rescission by any purchaser.
Bidding: All purchasers are required to have a bidding card for which they will sign that they agree to the terms of this sale. Do not lose your bidding card; you are responsible for all purchases charged to your number. Auctioneer reserves the right to refuse any applicant for a bidding card the privilege of bidding at this auction sale and to revoke such privilege at any time. The highest bidder whose bid is accepted by Auctioneer shall be the purchaser, and no purchaser shall retract his bid. All sales are final.
Buyer Premiums: A 10% Buyer’s Premium will apply requiring purchaser to pay a premium in addition to the sale price that is calculated on a percentage of the sales price. By bidding at this sale, purchaser agrees to pay the Buyer’s Premium announced or posted at the auction.
Addition to or Withdrawal From the Sale: Auctioneer reserves the right to withdraw from the sale any of the items listed or to sell items not listed and to group lots together or to subdivide a lot into two or more selling lots. Auctioneer also reserves the right to bid and to reject any and all bids.
Dispute Between Bidders: If any dispute arises between bidders, Auctioneer may decide the same or may immediately put the lot up for sale again. The decision of Auctioneer shall be absolute and final.
Removal: Items are to be removed from the premises by 4pm on Friday September 15, 2017. No purchases may be removed from the sale site until paid for in full. Removal shall be at the expense, liability, and risk of the purchaser. Purchaser hereby indemnifies and holds harmless Auctioneer and seller for any and all damage, claim or liability for injuries to persons or property caused by the removal of items purchased. Auctioneer may choose to assist purchaser in loading, dismantling and removing items at no charge to purchaser. In accepting assistance from Auctioneer, purchaser agrees to indemnify and hold auctioneer harmless from any damage caused by Auctioneer or others during said loading, dismantling or removal. Auctioneer shall not be liable for theft, non-delivery or damage to items once the items are declared “sold” to purchaser. Auctioneer has the option, at the expense and risk of the purchaser, of removing and storing any goods not removed within the time specified. Auctioneer reserves the right to require proof of adequate insurance coverage from any purchaser of lots requiring dismantling or hot cutting.
